RICHMOND, N. J.– A Pennsylvania man accused of buying several prescription drugs without a prescription is being sentenced to three months in federal prison and a $2 million fine.
Michael M. "Maggie" O'Connor, 46, faces a maximum prison sentence of five years and two months, U. S. District Judge Kenneth Magidson said in a news release.
O'Connor, who is also charged with first-degree misdemeanor criminal possession of a controlled substance, faces a maximum sentence of 15 years and two months.
"This is not the first time someone has taken a drug that is unsafe for human consumption, and I will not tolerate this drug if it is not approved by the Food and Drug Administration, I will not give it to anyone who does not require a prescription for a treatment," said U. Attorney Jeffrey A. Goldstein.
Assistant U. Attorney Bradley Bassett issued a news release about the case Friday, saying that O'Connor's case is "frightening" because he purchased more than 200,000 pills of the drugs without a prescription.
The government did not immediately respond to a request for comment.
Federal prosecutors said that O'Connor illegally imported a range of prescription drugs into the United States from China, from Thailand and the Philippines, where he had a chance to buy one of the drugs from a doctor.
"This was in the U. S., in China, in Thailand, in Mexico, and at some point in time in my career I have used a different prescription drug. I think the government is being dishonest with me and I would appreciate any further information," said Mr. O'Connor, who pleaded guilty to one count of conspiracy to traffic in counterfeit prescription drugs and to mail and wire fraud.
"I will not tolerate this drug if it is not approved by the Food and Drug Administration, I will not give it to anyone who does not require a prescription for a treatment," he said.
The two men were arrested in U. District Court on Jan. 23, 2009, and were being held without bond in the United States until May 21.
"The government does not intend to harm the public by withholding information, or by delaying or obstructing justice in any way," Mr. O'Connor's lawyer, Edward A. Schondelmeyer, said.
O'Connor's lawyer, Jason M. "Kris" O'Connor, said in a statement that he was in the process of filing a pro-bono application to have a federal judge sentence him to a maximum sentence of 10 years and two months, and that his client was being held in federal custody.
"I am disappointed that this is not a positive outcome, because the government did not know how long this was going to take. We did not know what to do," Mr. O'Connor said.
In his statement, Mr. O'Connor said that he was disappointed when the judge ordered him to pay $2 million in restitution to the victims of the deaths of two of his employees in June.
"It is clear to me that I would not have approved the purchase of this drug if I had known, or even suspected, that it would be dangerous to my employees and myself," he said.
In a statement, Mr. O'Connor said that he did not believe that the drugs were dangerous because they were not approved for sale by the Food and Drug Administration.
"We do not know if there are other drugs that can have dangerous side effects," he said.
In the United States, the Food and Drug Administration (FDA) approved a range of prescription drugs, including Viagra, Levitra and Cialis, for sale without a prescription. It also approved the sale of over-the-counter drugs, such as Cialis, for impotence or erectile dysfunction.
"The FDA requires a patient to prove that the product had a dangerous effect or impairment on the ability to have an erection," Mr.
A generic version of Viagra, Cialis, was approved by the FDA in 1998. Viagra was not approved for the treatment of erectile dysfunction. Cialis was approved for use in the treatment of pulmonary arterial hypertension.
Two of the drugs O'Connor purchased were also not approved by the FDA. A generic version of Cialis, Levitra, and Levitra XR, was approved in 2003. Cialis XR was approved in 2005.
